US v Trump-Nauta 23-80101 by CBS News

Former President Donald Trump has been indicted on 37 felony counts related to the presence of classified information at his Florida estate and other locations after leaving office. Prosecutors allege that Trump arranged for the removal of a significant collection of highly sensitive classified material, including intelligence on defense and weapons capabilities, to his private residence at Mar-a-Lago. The indictment states that Trump showed classified documents to visitors without security clearances at his New Jersey golf club and ordered his aides to move boxes with classified records to obstruct investigators. The charges include violations of the Espionage Act, obstruction of justice, and false statements.

Special counsel Jack Smith’s team presents evidence portraying Trump as an ex-president who disregarded the significance of protecting classified information and instead stored documents haphazardly throughout his estate. An incident in which boxes containing classified records were found toppled in Mar-a-Lago’s storage room is highlighted. Trump’s alleged involvement in orchestrating the removal of these boxes before investigators arrived is also emphasized. If convicted on all counts, Trump could face substantial prison time, with each count of willful retention of records carrying a maximum 10-year sentence.

In addition to this indictment, Trump already faces a separate 34-count indictment in New York for allegedly falsifying business records related to hush money payments made before the 2016 election. Ongoing investigations into Trump’s attempts to undermine the 2020 election and his election-related actions could result in further charges. Trump is scheduled to appear in federal court in Miami for an initial hearing. The indictment highlights 31 specific documents that Trump intentionally withheld from federal officials, including Top Secret and secret records, further underscoring his awareness of the significance of safeguarding classified information.
